Description
The Indian Evidence Act 1972, Secs, 5 to 55 of relevancy of facts contains two chapters. Chapter I deals with an Introduction to Indian Evidence Act with particular reference to “of relevancy of facts”. Chapter II deals with relevance of facts as stated by Sir Stephen. in his book “THE INDIAN EVIDENCE ACT(I) OF 1872 WITH AN INTRODUCTION ON THE PRINCIPLES OF JUDICIAL EVIDENCE BY JAMES FITZJAMES STEPHEN, CALCUTTA THACKER SPRINK AND CO” particularly giving reference to citation of English Court, an attempt has been made in chapter II to discuss admissibility and relevancy or otherwise from the citations of Indian High Courts and the Apex Court. Concept of relevancy vis-a-vis admissibility or otherwise, with reference to the provisions of various secs.5 to 55may be stated that what is relevant is not necessarily admissible, However, what is admissible if so facto is relevant.
About the Author
The author retired as Dy, Supdt of police in February 2005. He is a trained Handwriting Expert He is a science and law graduate, and registered as an advocate with BAR COUNCIL OF INDIA during Feb 2006 and practised as an advocate and defended accused persons in Courts for period of six years and gained experienced and insight in to the Corruption Laws.
